Terms of Service

ARTICLE 1: Definitions

The purpose of this clause is to define the various essential terms of the contract:

“User” means any person who uses the site or one of the services offered by the site.

“User Content” means the data transmitted by the User within the site.

“Member” means any identified User on the site.

“Username and password” means all the information necessary to identify a User on the site. The username and password allow the User to access services reserved for site members. The password is confidential.

ARTICLE 2: Purpose

atelieradc.com reserves the right to unilaterally modify the content of these terms and conditions of use at any time.

The site atelieradc.com is published by ATELIER DES CREATEURS LDA with a capital of €4555.000, whose headquarters is located at Rua José Falcão 95, 4050 317 Porto (Portugal).

The site atelieradc.com is hosted by OVH, whose headquarters is located at 2 rue Kellermann – 59100 Roubaix – France.

ARTICLE 4: Access to Services

The site provides the User with free access to the following services:

- Content consultation
- Contact form

The site is accessible for free in any location to any User with Internet access. All costs incurred by the User to access the service (computer hardware, software, Internet connection, etc.) are at their expense.

The site implements all available means to ensure quality access to its services. The obligation is one of means, the site does not commit to achieving this result.

Any event due to a case of force majeure resulting in a network or server malfunction does not engage the responsibility of atelieradc.com.

Access to the site's services may be interrupted, suspended, or modified at any time without notice for maintenance or any other reason. The User agrees not to seek any compensation following the interruption, suspension, or modification of this contract.

ARTICLE 5: Intellectual Property

Trademarks, logos, and all elements and content appearing on the Site are the property of Atelier Des Créateurs and are protected worldwide under copyright and intellectual property rights.

Their reproduction, even partial, is strictly prohibited, except with prior and express authorization from Atelier Des Créateurs.

In the same conditions, the User is granted a strictly private use.

Any reproduction or any other use constitutes counterfeiting and is punishable as such under the Intellectual Property Code.

ARTICLE 6: Personal Data

The information requested during site registration is necessary and mandatory for the creation of the User's account. In particular, the email address may be used by the site for administration, management, and service animation.

The site ensures the User collects and processes personal information in respect of privacy in accordance with Law No. 78-17 of January 6, 1978, relating to data processing, files, and freedoms.

Under Articles 48 et seq. of Law No. 78-17 relating to data processing, files, and freedoms dated January 6, 1978, rewritten by Ordinance No. 2018-1125 of December 12, 2018, applicable from June 1, 2019, the User has a right of access, rectification, deletion, and opposition of their personal data. The User exercises this right via:

- By post Rua José Falcão 95, 4050 317 Porto (Portugal).

ARTICLE 7: Liability and Force Majeure

The sources of the information disseminated on the site are deemed reliable. However, the site reserves the right to a non-guarantee of the reliability of the sources. The information provided on the site is for informational purposes only. Thus, the User assumes sole responsibility for the use of the information and content of this site.

The User ensures to keep their password secret. Any disclosure of the password, in any form, is prohibited.

The User assumes the risks associated with the use of their username and password. The site declines all responsibility.

Any use of the service by the User directly or indirectly causing damage will be subject to compensation for the benefit of the site.

An optimal guarantee of the security and confidentiality of the data transmitted is not assured by the site. However, the site undertakes to implement all necessary means to best ensure the security and confidentiality of data.

The site’s responsibility cannot be engaged in the event of force majeure or the unforeseeable and insurmountable act of a third party.

ARTICLE 8: Hypertext Links

Outgoing hypertext links are present on the site. However, the content of the web pages to which these links lead does not engage the responsibility of atelieradc.com.

The User, therefore, refrains from engaging the site’s responsibility concerning the content and resources relating to these outgoing hypertext links.

ARTICLE 9: Evolution of the Contract

The site reserves the right to modify the clauses stipulated in this contract at any time.

ARTICLE 10: Duration

The duration of this contract is indefinite. The contract produces its effects towards the User from the use of the service.

ARTICLE 11: Applicable Law and Jurisdiction

These terms are subject to French law

Any dispute relating to the formation, conclusion, validity, interpretation, performance, or termination of these terms falls under the exclusive jurisdiction of the Commercial Court of Paris, notwithstanding multiple defendants or third-party claims.
